Guide
Selling your lake house: the papers, the taxes, the timing
A house on Lake Orta sells well when the buyer, their notary and their bank find everything in order at first glance. This guide is for those who already own one: what the deed must contain so that it is not void, how the small discrepancies of an old house are handled, when a sale is taxed and when it is not, what changes if you live abroad, and how many homes actually change hands around the lake. The rules are those in force at the end of October 2026; from 1 January 2027 the new consolidated income tax code changes the article numbers but not the rules.

In short
- The deed is void without the reference to the cadastral floor plans, with the declaration that they match the actual state, and without the references of the house's building permits. For houses started before 1 September 1967 the permit is replaced by the owner's declaration.
- Small differences from the approved drawings are not violations if they stay within the tolerances: 2% of the measurements, and for work done on or before 24 May 2024 from 2% to 6% depending on floor area. A technician declares them, also in an affidavit annexed to the deed of sale.
- The energy certificate (APE) must be shown at the start of negotiations and attached to the deed: without it, a fine from €3,000 to €18,000.
- Capital gains tax is due only if you sell within 5 years of buying; never on an inherited house. For a gifted house the clock starts when the donor bought it. If you ask, the notary applies a 26% substitute tax at completion. This applies to sellers living abroad too.
- In 2025 the OMI area «Lago d'Orta» in the province of Novara recorded 119 home sales, a third more than in 2024, about 2 homes in every 100; in north-west Italy outside the big cities a home sells in 5.7 months at an average discount of 7.2% on the asking price.
Before the listing: the house must be the one in the papers
Land registry. Every deed transferring an existing house must cite the floor plans filed with the land registry and contain the owners' declaration that cadastral data and plans match the actual state; the declaration can be replaced by a qualified technician's certificate. Without it the deed is void. Before signing, the notary also checks that the cadastral owners match the property registers1. A moved staircase, a cellar turned into a room, a closed-in porch: these are the first things to look at, because the land registry is updated before the deed, not after.
Legitimate state (stato legittimo). It is the house as described by the permit under which it was built, or by the one that governed the last works on the whole building, plus the permits for later partial works; amnesties and fines paid count too. For houses built when no permit was required, the first cadastral survey, photographs, archive papers and other documents of certain origin apply2. On the lake, with its old villages and hillside farmhouses, it pays to know from the start which of the two routes applies to your house.
What the deed must state depends on when the house was built:
| When the works began | What the deed must state | If it is missing |
|---|---|---|
| Before 1 September 1967 | a sworn declaration by the owner that works began before that date4 | deed void; curable with a confirming deed if the requirement existed4 |
| 1 September 1967 to 17 March 1985 | the references of the licence or building concession, or of the amnesty application with the first two instalments of the fee paid4 | as above4 |
| After 17 March 1985 | the references of the building permit, the SCIA or the retrospective permit, declared by the seller3 | deed void; it can be confirmed if the permit existed3 |
| Always, for an existing house | the reference to the cadastral plans and the declaration that they match the actual state1 | deed void; it can be confirmed if the plans existed and matched1 |
Habitability (agibilità). Today it is attested by a certified notice, required after new construction, rebuilding and works affecting safety, hygiene, healthiness or energy saving; failing to file it when due costs from €77 to €4645. In the rules we read, its absence does not make the deed void: but the buyer and their bank will ask for it, and if it is missing they must be told before the preliminary contract.
The full list, with where to request each document, is in the tool Documents to sell.
Small discrepancies: tolerances and regularisation after the 2024 «Salva-casa» decree
In lake houses the measurements rarely match thirty-year-old drawings to the centimetre. The law does not treat as a violation a deviation within 2% in height, distances, volume, covered area or any other parameter; for work done on or before 24 May 2024 the margin allowed rises as the unit gets smaller6:
| Usable floor area of the unit (as in the permit) | Tolerance |
|---|---|
| over 500 m² | 2% |
| 300 to 500 m² | 3% |
| 100 to 300 m² | 4% |
| 60 to 100 m² | 5% |
| under 60 m² | 6% |
Then there are execution tolerances: minor geometric irregularities, finishes, systems and internal works placed differently during construction. Note the point that matters on the lake: the law allows them only for buildings that the Cultural Heritage and Landscape Code does not protect6. Many lakeside houses lie within the 300-metre band or in the areas of the 1985 decrees described in the guide Renovating on the lake: ask your technician whether your house is affected before relying on them.
Tolerances are not «regularised»: the technician declares them, in later building applications or in an affidavit annexed to the deed of sale6. It is worth having it ready before the preliminary contract.
Beyond the tolerances. For partial discrepancies from a building permit or a SCIA, the law since 2024 allows today's owner, not only whoever did the works, to apply for regularisation if the work complies with current planning rules and with the building rules in force when it was done. A fee is due: for discrepancies from a permit, twice the building contribution increased by 20%, without the increase if the work complied both then and now; for works without a SCIA or departing from it, twice the increase in value estimated by the Revenue Agency, from €1,032 to €10,328, from €516 to €5,164 if the work complied both then and now7.
And the landscape? If the non-compliant works also lacked landscape authorisation, the office asks the authority in charge of the constraint for a binding opinion, even where they created floor area or volume: the authority decides within 180 days, the heritage superintendency gives its view within 90, and if the opinions do not arrive, silence counts as consent. If the works are found compatible, a further fine equal to the greater of the damage and the profit is due; if not, they are demolished7. This route covers partial discrepancies and SCIA works; for works done without a building permit or in total departure from it the rules are stricter, and for the landscape see Renovating on the lake.
Energy certificate, systems, condominium, agent: what goes into the deed
The energy performance certificate must be made available to the buyer when negotiations start and handed over at the end; in the deed the buyer declares having received it and a copy is attached. If the declaration or the attachment is missing, the parties pay, jointly and in equal shares, from €3,000 to €18,0008. The sale listing must show the energy indicators, or whoever publishes it pays from €500 to €3,000; the certificate is valid for up to 10 years8.
Systems. The article of the systems decree that required handing compliance declarations to the buyer and annexing them to the deed was struck out in 20089: attaching them is no longer an obligation. The declarations are still the simplest way to answer a buyer's questions; if you do not have them, say so and write it into the preliminary contract.
The condominium, if the house is part of one: the buyer answers, jointly with the seller, for contributions of this year and last year; the seller remains liable for charges accruing until the administrator receives a certified copy of the deed10. Ask the administrator for the payment position before the preliminary contract and send them the deed right after completion.
Payment and agent. Seller and buyer state in the deed how the money moved and whether an agent was involved, with the agent's details, registration number and the fee paid. An omitted or false declaration costs from €500 to €10,000 and leads the Revenue Agency to reassess the value11.
The buoy and the jetty do not go with the house: the concession is personal and passes to the buyer only with a new title and if nobody else has applied. How it works, and what to prepare, is in the guide Boats, buoys and swimming.
The seller's taxes: capital gains
A private individual's sale of a house is taxed in one case only: if it was bought or built no more than 5 years earlier. The difference between the price received and the price paid, plus any other cost that belongs to the house, is a capital gain that is added to the year's income12. Left out are a house received by inheritance and one in which the seller, or a family member, had their main home for more than half the time they owned it12.
| Your lake house | Is the gain taxed? | From when the years run, on what cost |
|---|---|---|
| bought or built more than 5 years ago | no | from the date of purchase or construction12 |
| bought 5 years ago or less | yes, unless it was the main home for more than half the time | price paid plus documented inherent costs12 |
| inherited | no | —12 |
| received as a gift | yes, if 5 years have not passed since the donor's purchase | from the donor's purchase, on the donor's cost plus gift tax12 |
| with superbonus works completed no more than 10 years ago | yes, except inheritance or main home for more than half the time | 110% costs with invoice discount or credit transfer do not count if the works ended 5 years ago or less, count by half if longer12 |
The preliminary contract does not move the clock. What counts is the date of the purchase deed and that of the sale deed: a preliminary contract signed and a deposit received before the 5 years do not trigger the gain, and the sale stays exempt if the deed comes after. But a garage, a cellar or a piece of garden bought later have their own count: if you sell them with the house within 5 years of buying them, the part of the price relating to them is taxed14.
How it is paid. At the deed you can ask the notary to apply a 26% substitute tax: the notary works it out, takes the amount from you and pays it13; otherwise the gain goes into your tax return and pays the year's IRPEF12. Which is better depends on the rest of your Italian income: it is a calculation to make with an accountant before signing.
An example with the lake's figures. Assumptions: a 150 m² villa in OMI zone B2 of Orta San Giulio (lakefront and island), bought in December 2024 at the centre of the OMI range of the time, 1,900–2,800 €/m², and sold in 2026 at the centre of the 2nd-half-2025 range, 2,100–3,000 €/m²19. Purchase €352,500, sale €382,500: a difference of €30,000. Less €20,000 of documented costs your adviser accepts as inherent (assumption: purchase taxes and notary, invoiced works), €10,000 remain; the substitute tax is €2,600. If the sale deed comes more than five years after the purchase, that is from December 2029, it is zero. OMI quotations are estimates per zone, not prices: your case is made by the real price and the real invoices.
IMU in the year of sale is split by months between seller and buyer; the rule on months and the day of the deed, and the rates of the thirteen municipalities, are in the guide IMU property tax on the lake.
In 2027 the same rules change address: from 1 January the new consolidated code (Legislative Decree 117/2026) holds them in articles 25, 76, 77 and 244, with the same thresholds and the same rate13. The Council of Ministers' press release on the 2027 budget bill, of 28 October 2026, announces for housing the flat tax on agreed-rent leases and the one on commercial premises, not changes to capital gains20; we have not yet read the official text of the bill.
Inherited or gifted house: the extra papers
Whoever sells an inherited house pays no capital gains tax, but must have the succession in order: the buyer's notary traces the transfers of ownership in the registers, and the title must be proven as for any other house. The tool Documents to sell lists the deeds to retrieve.
For a house received as a gift the historic problem was different: the donor's children or spouse whose reserved share had been infringed could, on the donor's death, claim the house back even from whoever had bought it from the donee15. With Law 182 of 2025, in force since 18 December 2025, reduction of the gift no longer affects the buyer: the forced heirs are owed monetary compensation by the donee15. The new rule applies to successions opened after that date, and also to earlier ones if by 18 June 2026 none of the forced heirs had served and registered a reduction claim or formally opposed the gift15. If your lake house was given to you, have the notary check exactly this in the property registers.
If you live abroad
If the house is yours but you live in Germany, Switzerland, the Netherlands or the United Kingdom, for the Italian tax authorities you are non-resident, and a non-resident is taxed in Italy on income from assets located in Italy12: if you sell within 5 years of buying, the gain on the lake house is taxed here, and the notary can apply the 26% for you just as for a resident13. From 2027 the same rule is in article 25 of the new code13.
What your own country does with the same sale, and how the double taxation treaty divides the right to tax, depends on the country: ask an adviser there before the preliminary contract. To sign you need an Italian tax code (requested from the consulate, as explained in Buying property in Italy) and to appear before the notary; whoever cannot come signs through a power of attorney, which must have the same written form required for the sale16.
If after the sale you move to the lake yourself, or leave it, the guide Moving to the lake explains what changes for residence and taxes.
How many homes sell on the lake, and how fast
The Property Market Observatory divides provinces into macro-areas of neighbouring municipalities. The lake touches two: «Lago d'Orta» in the province of Novara and «Cusio» in Verbano-Cusio-Ossola17. In 2025 the first recorded 119 home sales, 34.9% more than in 2024, and the highest average quotation in the province, 1,423 €/m²; Cusio 291, with the lowest average quotation in the VCO17:
| Area | Sales 2025 | Change on 2024 | Share of stock sold | Average quotation 2025 |
|---|---|---|---|---|
| Lago d'Orta (macro-area, NO) | 119 | +34.9% | 1.97% | 1,423 €/m² (+3.6%) |
| Cusio (macro-area, VB) | 291 | +2.9% | 1.77% | 1,013 €/m² (+0.4%) |
| Province of Novara | 5,852 | +14.0% | 2.72% | 1,070 €/m² (+3.5%) |
| Province of VCO | 2,700 | +7.6% | 1.97% | 1,275 €/m² (+1.0%) |
A stock share of about 1.97% means that in a year one home in fifty changes hands. It is a small market: few sales, and each one counts. Quotations by municipality and zone are in the guide Lake Orta property prices.
On timing there is no figure for the lake alone. The Bank of Italy's quarterly survey of about 1,500 agencies gives these values for the second quarter of 202618:
| Area | Months from mandate to sale | Average discount on asking price |
|---|---|---|
| Italy | 5.2 | 7.1% |
| North-west | 5.1 | 6.9% |
| North-west, outside urban areas over 250,000 inhabitants | 5.7 | 7.2% |
According to the Bank of Italy, discounts and times are close to their lowest since the survey began, while new mandates to sell keep falling18: there is less supply. The lake is a «non-urban area» of the north-west; a second home with a view, though, has buyers of its own and times no statistic measures.
If you are thinking of selling
The first step costs little: cadastral record, floor plan, building permits and energy certificate on the table, and a technician to say whether the house matches. The tool From price to net shows what is left from a price after taxes and costs; What is my home worth gives the OMI range for your zone.
If you prefer a personal view on price, papers and timing, you can tell us about your house: we look at it and tell you what we think. If instead the idea is to keep it and make it earn, start with Renting out your lake home.
What we do not know yet
Whatever we have not yet read in a reliable source we list here, instead of passing it off as certain.
- Exactly which municipalities make up the OMI macro-areas «Lago d'Orta» and «Cusio»: the Observatory shows them only on a map.
- Selling times and discounts measured on Lake Orta alone: the closest figure is the Bank of Italy's for non-urban areas of the north-west.
- How technicians and the lake's municipalities apply the limit on execution tolerances to «protected» buildings when the constraint is only a landscape one.
- The official text of the 2027 budget: whether, before becoming law, it brings anything new for sellers.
- How your country of residence taxes the sale, and what its treaty with Italy provides.
Questions
Is capital gains tax due when selling a second home on Lake Orta?
Only if you sell within 5 years of buying, and never on an inherited house. If you ask, the notary applies the 26% substitute tax at completion on the difference between sale price and purchase cost plus inherent costs.
If I signed the preliminary contract before the five years, do I pay?
No, if the deed comes after the five years: for the Revenue Agency the dates of the deeds count, not that of the preliminary contract or the deposit. The exception is appurtenances bought later, which have their own five years.
I live in Germany (or Switzerland, the Netherlands, the UK): do I pay capital gains tax in Italy?
Yes, if the sale falls within five years of the purchase: the house is in Italy and the income is treated as produced here. What your own country then does depends on its rules and its treaty with Italy: ask an adviser there.
My lake house differs slightly from the approved drawings: can I sell it?
Yes, if the differences stay within the tolerances (2%, and for works done by 24 May 2024 from 2% to 6% depending on floor area): a technician declares them, also in an affidavit annexed to the deed of sale. Beyond that, regularisation is assessed; if the house is in the lake's protected band, a landscape opinion is also needed.
Do I need an energy certificate to sell?
Yes: it must be shown at the start of negotiations, its indicators go into the listing and a copy goes with the deed; without one, the fine is between €3,000 and €18,000.
How many homes sell on Lake Orta?
In 2025, 119 in the OMI macro-area «Lago d'Orta» in the province of Novara (34.9% on 2024) and 291 in Cusio, in the province of VCO: about two homes in a hundred in a year.
